- چکیده: عدم تحقق حقهای اقتصادی اجتماعی[1] و فقر شدید که در سطوح جهانی، منطقهای، ملّی و محلّی جامعه بشری با آن روبروست از عدم اتخاذ تصمیمات بهینه اقتصادی نشأت میگیرنداین در حالی است که امروزه حق برتوسعهو حکمرانی مطلوب بعنوان راهبردی ارزشمند جهت کاهش فقر و توسعه، در عرصه بین المللی بعنوان ضابطه ای هنجاری شناخته می شوند. بر این اساس این موضوع در چارچوب تکلیف منشور سازمان ملل متحد دائر بر همکاری بینالمللی جهت حصول توسعه اقتصادی و اجتماعی نیازمند تدبیر جامعه جهانی بوده در این راستا الگوی اقتصادی چارچوب میان مدت هزینه توسط بانک جهانی[2] به عنوان یکی از سازمانهای بین المللی فعال در عرصه سیاست گذاری اقتصادی که مبتنی بر اهداف منشور ملل متحد و اهداف خود ، تحقق حقهای اقتصادی و اجتماعی ومالاً توسعه کشور ها از طریق اصلاح مدیریت مالی بخش عمومی دنبال می نماید ارائه شده است زیرا حقهای اقتصادی و اجتماعی مبتنی براسناد حقوق بین الملل در حوزه حقوق بشر، در زمره تعهدات «ایجابی»، «هزینه بر»،«وابسته به امکانات»،« تدریجی» و«برنامهای» میباشند براین اساس تحقق آنها مستلزم" برنامه ریزی" و"تخصیص منابع مالی" بوده بنابراین اجرای این حقها از طریق مکانیزم «برنامه مالی دولت» عملیاتی میگردد. این الگو با حمایت بانک جهانی در بیش از 130 کشور جهان، اجرا شده است. بنابراین هدف تحقیق حاضر این است؛ اولاً مشخص نماید این الگوی اقتصادی با کدامیک از منابع حقوق بینالملل تطابق دارد، ثانیاً با بررسی نتایج حاصل از اجرای این مدل در برخی کشورهای شمال و جنوب تحقق حقهای اقتصادی و اجتماعی به روش تحلیلی-توصیفی با استفاده از منابع کتابخانهای تبیین شود. نتایج تحقیق حاکی است که الگوی اقتصادی بانک جهانی "چارچوب میان مدت هزینه" به لحاظ مبنای حقوقی به عنوان مصداقی از "حقوق نرم[3]"در چارچوب اعلامیه حق بر توسعه سازمان ملل متحد قابل ارزیابی استلیکن دولتها بر اساس نظم هنجاری ناشی از حقوق بشر غایتگرا بدان ملتزم هستند زیرا فقر مغایر حقوق بشر بوده و کرامت انسانی را نقض میکند لذا پیش شرط تحقق آن ؛ اتخاذ سیاستهای اقتصادی سالم و شفاف، سرمایهگذاریهای عمومی مناسب و توسعه همه جانبه به ویژه در مسائل مربوط به آموزش، بهداشت، سلامت، زیرساختها، توسعه بخش کشاورزی، ایجاد فرصتهای بیشتر برای کار آبرومند، مدیریت درست امور اداری و.... که همگی درگرو مدیریت صحیح منابع عمومی در اختیار دولتها است. همچنین چارچوب میان مدت هزینه از سوی کشورها به عنوان ابزار بهبود عملکرد مالی در نظر گرفته شده زیرا این الگو اقتصادی بین دو مولفه سیاستگذاری و برنامهریزی با «برنامه مالی دولت» یک چارچوب ارتباطدهنده ایجاد مینماید این درحالی است که غالب الگوهای ارایه شده در رابطه با برنامه مالی دولت فاقد این سیستم ارتباطدهنده هستندبنابراین اجرای این مدل از سوی کشورهااز یک سو سبب نظاممند شدن قدرت سیاسی در امر هدایت منابع عمومی و تحقق حکمرانی مطلوب[4] بوده و ازسوی دیگر در راستای حقوق بینالملل غایت گرا میتواند اهداف متعالی اسناد حقوق بشری در تحقق حقهای اقتصادی و اجتماعی را تامین نماید.

[1] Social and Economic Rights [2] World Bank [3] Soft Law [4] Good Governance- چکیده انگلیسی: Non-realization of socio-economic rights and the severe poverty affecting the human society at global, regional, national and local levels stem from the lack of optimal economic decision-making. Accordingly, this issue has been raised in the United Nation's Chart implying that the achievement of economic and social development needs international community measures. In this regard, the economic model known as Medium Term Expenditure Framework has been proposed by the World Bank, as one of the international organizations active in the field of economic policy, which, based on its own goals and the UN Charter's objectives, pursues economic, social and financial rights and development of countries through financial management reform of the public sector considering that based on international human rights instruments economic and social rights are included in "positive", "cost-effective", "opportunity-dependent", "gradual" and "programmatic" commitments. Since the way it is realized requires "planning" and "allocation of financial resources", the implementation of this right is made operational through the "government's financial program" mechanisms. This model has been implemented with the support of the World Bank in more than 130 countries around the world. The purpose of the present study is, first, to determine which international law sources this economic model corresponds with, and, second, to explain the results from the implementation of this model in developed and developing countries and the realization of economic and social rights in form of a descriptive analysis method using library resources. The results of the study indicate that legally considered, the World Bank's economic model (Medium Term Expenditure Framework) can be evaluated as an embodiment of "Soft Law" within the framework of the UN Declaration on Right to Development. However, governments are obliged to respect it based on the normative order of human rights as poverty is contrary to human rights and it violates human dignity. To realize this, several preconditions should be met, which include adopting sound and transparent economic policies, appropriate public investment and comprehensive development, especially in matters related to education, health, infrastructure, agricultural development, creation of more opportunities for decent work, proper management of administrative affairs, etc., all of which are dependent on governments to properly manage public resources. Medium Term Expenditure Framework has also been focused by countries as a tool to improve financial performance. In the meantime, this economic model creates a communicative framework between the two components of policy and planning with the "government financial plan", while most of the models presented in relation to the government's financial plan do not have this communication system. Therefore, the implementation of this model by countries results in the systematization of political power in directing public resources, on the one hand, and achieving good governance, on the other hand, in line with ultimate international law, thereby providing for the excellent objectives of human rights documents with respect to economic and social rights.

- چکیده: مالکیت به ویژه دو مقوله مالکیت و فردی و اجتماعی، از بحث برانگیزترین مفاهیم انسانی است. مالکیت فردی و اجتماعی در جوامع مختلف، ارزش متفاوتی دارند. جوامع غربی و سرمایهداری، برای مالکیت فردی و جوامع سوسیایستی و کمونیستی برای مالکیت اجتماعی ارزش بیشتری قائل هستند. این امر پیامدهای مختلفی برای این جوامع داشته است و ساختار اقتصادی آنها را تحت تاثیر قرار داده است. در جامعه ایران به دلیل تسلط ارزشهای اسلامی، حکومت همواره در تلاش بوده که قوانین مالکیت را مطابق با فقه اسلامی تنظیم کند. در حقوق ایران مالکیت و حدود آن، هم شامل مالکیت عمومی است و هم منافع خصوصی را در بر میگیرد. در این مطالعه، به ابعاد مختلف مالکیت از منظر اجتماعی پرداخته میشود. ارزشهای اسلامی نقش مهمی در وضع حدود مالکیت و پیامدهایی برای جامعه دارند. برخی از مهمترین ارزشهای اسلامی که در تعیین حدود مالکیت اهمیت دارند عبارتند از همبستگی و عدالت. پژوهش حاضر تلاش نمود با اتکا به این ارزشها، پیشنهادهایی در مورد حدود مالکیت در ایران ارائه کند.
- چکیده انگلیسی: Ownership, in particular, of two categories of property, individual and social, is one of the most controversial human concepts. Individual and social ownership is different in different societies. Western societies and capitalism are more valuable to individual ownership and socialist and communist societies for social ownership. This has had various consequences for these communities and their economic structure has been affected. In Iranian society, due to the domination of Islamic values, the government has always tried to regulate ownershiplaws in accordance with Islamic jurisprudence. In Iranian law, its ownership and scope is both public ownership and private interests. In this study, different dimensions of ownershipfrom a social perspective are addressed. Islamic values play an important role in determining the limits of ownership and consequences for society. Some of the most important Islamic values that matter in determining the scope of ownership include solidarity and justice. The present research attempted to offer suggestions on the extent of ownership in Iran based on these values.
